Mr. Davis represents clients in the oil and gas, energy, public utility, real estate and food packaging industries. Mr. Davis’s work in the oil and gas, energy and public utility industries includes representing clients in eminent domain matters. Mr. Davis also has extensive experience in commercial litigation, including representing publicly traded companies and majority and minority interests in closely held corporations and partnerships. As lead counsel he has successfully tried commercial and personal injury actions and obtained multiple summary judgments and involuntary dismissals.

Mr. Davis is a founding shareholder of Hicks, Davis Wynn, P.C. – a litigation firm.  Prior to co-founding HDW, Mr. Davis was a partner at Beirne, Maynard & Parsons, LLP.

  • Currently serving as lead counsel for multiple gas utility companies in condemnation actions and ancillary proceedings for the construction of new gas pipelines and related facilities.
  • Currently serving as lead counsel for multiple common carrier pipeline companies in condemnation actions and ancillary proceedings for the construction of new common carrier pipelines and related facilities.
  • Currently representing large Houston-based electric power and natural gas transmission and distribution provider in condemnation actions and ancillary proceedings for the construction of new overhead electric and gas pipeline facilities.
  • Currently representing large Houston-based electric power and natural gas transmission and distribution provider in injunction and easement enforcement actions to preserve and protect client’s property and easement rights.
  • Currently serving as lead trial counsel for major Houston-based midstream company in injunction proceedings filed to protect property rights and facilities installed within blanket easements, including enforcement of temporary injunctions obtained for client.
  • Currently serving as lead trial counsel for international chemical processing company in administrative proceedings regarding utility services and related over-billing.
  • Currently representing and defending an international chemical processing company against claims for personal injury related to alleged chemical exposure.
  • Currently serving as lead trial counsel for international food and liquid products packaging company in products liability, breach of contract and warranty actions pending in Texas and Kansas, respectively.
  • Currently serving as lead trial counsel for international food and liquid products packaging company in labor arbitration.
  • Currently serving as national lead trial counsel for international food and liquid products processing and packaging company.
  • Currently serving as lead trial counsel representing multiple service companies and sellers of Oil Country Tubular Goods (“OCTG”) in products liability, breach of contract and warranty actions in Texas.
  • Served as lead counsel for Fortune 100 international integrated energy company in lawsuit involving claims of personal injuries resulting from alleged chemical exposure, and successfully obtained indemnity and coverage for client.
  • Served as lead counsel and obtained take-nothing summary judgment for Fortune 100 international integrated energy company in lawsuit involving claims of breach of contract and tortious interference with contract.
  • Served as co-lead counsel for independent midstream energy company in multiple construction contract disputes concerning the construction of a cryogenic gas processing plant and related piping facilities which resulted in settlement.
  • Represented hydrocarbon cleaning, decontamination, and degassing company in the prosecution of claims involving breaches of contract and theft of confidential information, which resulted in favorable settlement in client’s favor.
  • Served as trial and appellate counsel for large independent midstream energy company in the successful prosecution of injunction proceedings filed to enjoin second-filed, parallel lawsuit pending in another jurisdiction.
  • Represented and successfully defended oil field services and construction company in business fraud claims relating to real estate transaction.
  • Represented and prosecuted claims for retail seller of hydrocarbon liquids in breach of contract and fraud action following asset sale, and successfully obtained settlement in client’s favor.
  • Represented a producer and transporter of petroleum products in condemnation and ancillary proceedings in its construction of a common carrier natural gas liquids pipeline connecting facilities in Oklahoma with facilities located on the Texas gulf coast.
  • Represented a pipeline affiliate of one of the main international integrated energy companies in condemnation and ancillary proceedings relating to a project to build a pipeline to transport product from a liquefied natural gas terminal on the Texas gulf coast to interconnections with various intrastate and interstate natural gas pipelines.
  • Served as trial and appellate counsel for major natural gas liquids (NGLs) pipeline company in injunction proceedings filed to enjoin prosecution of condemnation action and interference with client’s possession of property by competing pipeline company, which resulted in issuance of requested injunctive relief and continued viability of client’s interstate NGLs pipeline project.
  • Represented independent exploration and production energy company in easement and right-of-way acquisition for construction of gathering lines and related facilities.
  • Represented pipeline construction company against contract and tort claims following pipeline explosion during construction of new pipeline, which resulted in favorable settlement.
  • Trial counsel in injunction proceedings filed to enjoin commercial landlord’s interference with manufacturer’s use of leased premises and landlord’s attempted acquisition of the manufacturer’s specialized trade fixtures and equipment essential to manufacturer’s business, which resulted in issuance of requested injunctive relief.
  • Obtained final summary judgment dismissing all claims brought against an electric utility company by a contracted lineman following an electric shock accident that allegedly caused lineman brain damage, impaired hearing, back injury and shoulder injury.
  • Represented owners and lessees of mineral interests in actions against surface owners to enforce property rights associated with dominant mineral estate and obtained injunction allowing client to explore for minerals through the use of geophysical seismic survey.
  • Represented manufacturer of electrical component parts used on overhead electrical distribution lines and commercial light fixtures against claims involving personal injury and death.
  • Represented minority shareholders and limited partners in the prosecution of claims against numerous interrelated companies and those companies’ controlling shareholders and partners in complex dispute involving claims of minority shareholder oppression, breach of fiduciary duties and forfeiture, which resulted in favorable settlement.
  • Represented and obtained dismissals of claims against healthcare corporation and hospitals in medical malpractice, negligence, ERISA, and employment matters throughout Texas.
  • Represented numerous insurers and independent adjusting firms in high-exposure coverage/bad faith suits, including first party commercial property claims arising from catastrophic losses.
  • Represented manufacturer in breach of contract action involving manufacturer’s supplier of raw materials.
